These Terms & Conditions ("Terms") govern your access to and use of the HBCField web platform and mobile application (together, the "Service"), operated by HBC Group GmbH ("we", "our", "us"). HBCField is a business-to-business service. By creating an account or using the Service, you agree to these Terms.
1. Agreement to These Terms
By registering for, accessing, or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy. If you do not agree, you must not use the Service.
If you accept these Terms on behalf of an organization, you represent that you are authorized to bind that organization, and "you" refers to that organization. The Service is intended for professional and business use only and is not directed at consumers, except where mandatory law provides otherwise.
2. Definitions
In these Terms:
- "Service" — the HBCField web portal, mobile application, APIs, and related documentation.
- "Organization" — the company or entity that registers for an account and on whose behalf the Service is used.
- "Admin" — the organization owner or a user granted administrative rights, who manages users, access, and billing.
- "Member" — any user (office coordinator, dispatcher, or field technician) added to an Organization.
- "Seat" — a billable unit of access; every active Member counts as one seat at the same flat rate, whatever their access.
- "Customer Data" — all data your Organization and its Members submit to the Service, including tasks, reports, photos, locations, and comments.
3. The Service & Licence
HBCField provides a role-based platform for managing field service work — task creation and assignment, technician execution, GPS route tracking, attendance, service reports, and related features. We may add, change, or remove features over time.
Subject to these Terms and payment of applicable fees, we grant your Organization a non-exclusive, non-transferable, non-sublicensable right to access and use the Service for its internal business purposes during the term of your subscription.
You must not
- copy, modify, reverse-engineer, decompile, or create derivative works of the Service, except where permitted by mandatory law;
- resell, sublicense, rent, or otherwise make the Service available to third parties outside your Organization;
- circumvent usage limits, seat counts, plan restrictions, or security measures;
- use the Service to build a competing product or to scrape or extract data other than your own Customer Data.
4. Accounts & Organizations
When you register, an Organization is created and the registering user becomes its Admin. You are responsible for your account and for all activity under it. In particular:
- you must provide accurate, current, and complete information and keep it up to date;
- you are responsible for keeping login credentials confidential and for all actions taken through your account;
- the Admin controls which Members are added, their roles, and their access, and is responsible for their use of the Service;
- you must notify us promptly of any unauthorized access or security breach affecting your account.
5. Subscriptions, Seats & What You Pay For
The Service is offered on a monthly subscription. There are no plan tiers: every capability is available to every customer at the price listed on our pricing page, and what you pay is the sum of the people, modules and add-ons in effect.
Billing is per person, not per bundle. Every active Member counts as one seat at the same rate, whatever their access — there is no office/field distinction. Modules are enabled per site and billed for each site that enables them; some are additionally billed by a count (for example assets or customer records), on published volume rates.
What is charged (excl. VAT)
- Each person€9.99 per Member / month.
- Each modulefrom €3 per site / month, for each site that switches it on.
- Each add-onfrom €9 / month, purchased once for the whole Organization.
6. Fees, Billing & Proration
Fees are charged in euro (EUR) monthly in advance, based on the people, modules and add-ons in effect. When something changes mid-period, the amount is prorated as follows:
- Adding — changes are prorated and applied to your next invoice; adding a person or switching a module on does not trigger an immediate separate charge, but the prorated amount for the remainder of the current month is added to the following invoice.
- Removing seats — reductions never trigger a cash refund; the prorated value is banked as an account credit and applied to future invoices.
Payments are processed by Stripe. You authorize us and Stripe to charge your payment method for all fees due. You are responsible for keeping a valid payment method on file.
7. Taxes (VAT)
All prices are exclusive of value-added tax (VAT) and any other applicable taxes, which are added at checkout at the rate required by law. For customers in Austria, the standard VAT rate of 20% applies.
Business customers may enter a valid VAT identification number (UID) at checkout. For eligible cross-border transactions within the EU, the reverse-charge mechanism applies and no VAT is charged, in which case you are responsible for accounting for VAT in your own country. Domestic Austrian supplies remain subject to Austrian VAT even where a VAT ID is provided.
8. Free Trial
New Organizations may receive a free trial (currently 14 days) with every capability switched on, including those that are otherwise charged for. No payment method is required to start the trial.
Unless you subscribe to a paid plan before the trial ends, access is restricted at the end of the trial and the account is placed in a read-only state until a subscription is started. We may change or discontinue trial offers at any time.
9. Renewal, Cancellation & Refunds
- Automatic renewal — subscriptions renew automatically at the end of each monthly billing period at the then-current fees, until cancelled.
- Cancellation — you may cancel at any time from Settings → Billing or the Stripe Customer Portal. Cancellation takes effect at the end of the current paid period; you keep access until then.
- Refunds — except where required by mandatory law, fees already paid are non-refundable and we do not provide partial refunds for unused time or downgrades.
- Failed payments — if a payment fails, the subscription may be marked past due and access may be suspended or restricted until payment is resolved.
10. Acceptable Use
You agree not to, and not to allow any Member or third party to:
- use the Service in violation of any applicable law or regulation;
- upload or transmit unlawful, infringing, or malicious content, or malware;
- attempt to gain unauthorized access to the Service, other accounts, or our systems;
- interfere with or disrupt the integrity or performance of the Service;
- use location tracking or Member data in violation of employment, privacy, or data-protection laws applicable to your Organization;
- misrepresent your identity or your authority to act for an Organization.
11. Customer Data & Privacy
As between you and us, your Organization owns its Customer Data. You grant us a limited licence to host, process, and transmit Customer Data solely to provide and support the Service. You are responsible for the accuracy and legality of Customer Data and for having any consents or legal bases required to collect it (including location data of your Members).
Our handling of personal data is described in our Privacy Policy, which forms part of these Terms. Where we process personal data on your behalf, we act as processor and you as controller.
You can access and export your Customer Data while your subscription is active. After termination, we retain Customer Data for a limited period to allow export and then delete it in accordance with our retention practices and applicable law, unless longer retention is legally required.
12. Intellectual Property
The Service, including all software, design, trademarks, and content we provide, is and remains the exclusive property of HBC Group GmbH and its licensors. These Terms grant you a right to use the Service only; no ownership or other rights are transferred to you.
If you send us feedback or suggestions, you grant us a non-exclusive, royalty-free, perpetual licence to use them to improve the Service, without obligation to you.
13. Third-Party Services
The Service relies on third-party providers. Their services are governed by their own terms, and we are not responsible for their acts, omissions, or availability:
- Stripe — payment processing and subscription billing;
- Hetzner — EU-based cloud hosting and object storage;
- Expo, Firebase Cloud Messaging & Apple Push Notification Service — push-notification delivery;
- OpenStreetMap, OSRM & Nominatim — map tiles, routing, and address search.
14. Warranties, Availability & Liability
We aim to keep the Service available and reliable, but we do not guarantee uninterrupted or error-free operation. The Service may be temporarily unavailable for maintenance, updates, or reasons beyond our control.
To the maximum extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, or consequential damages, or for loss of profits, revenue, data, or business. Our total aggregate liability arising out of or relating to the Service is limited to the fees you paid to us in the twelve (12) months preceding the event giving rise to the claim.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for intent, gross negligence, personal injury, or under mandatory Austrian and EU law.
15. Term, Suspension & Termination
These Terms apply for as long as you use the Service or hold an active subscription. You may terminate by cancelling your subscription and ceasing to use the Service.
We may suspend or restrict access, in whole or in part, if you materially breach these Terms, fail to pay fees when due, or where required for legal or security reasons. Where practicable, we will give notice and an opportunity to remedy.
On termination, your right to use the Service ends and any outstanding fees become due. We will make Customer Data available for export for a limited period and then delete it as described in Section 11, unless mandatory law requires otherwise.
16. Governing Law, Changes & Contact
These Terms are governed by the laws of Austria, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods (CISG). The courts competent for the registered seat of HBC Group GmbH in Austria have exclusive jurisdiction, unless mandatory consumer-protection law provides otherwise.
We may update these Terms from time to time. We will notify you of material changes by email or in-app notice, and the "Last updated" date reflects the latest revision. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
